Terms of Service
Purpose
These Terms of Service govern the use of services offered by Bourez Bastien EI ("oneSubnet") on the onesubnet.com website.
Account
Using our services requires creating a client account via our billing platform. You agree to provide accurate information and keep it up to date. You are responsible for the confidentiality of your credentials.
Services
oneSubnet provides software publishing, development and application maintenance services, as well as managed digital environment solutions (including game server and voice server hosting — TeamSpeak 6 / Mumble — and application runtime environments), along with associated services (automated backups, Gcore Anti-DDoS). Territory and eligibility
oneSubnet services are intended for clients residing in France and within the European Economic Area (EEA). In line with our Professional Liability Insurance (insurer Hiscox), which does not cover the United States or Canada, the services are not offered to residents of those two territories. Any order from the United States or Canada may be refused or cancelled without compensation. The customer acknowledges that any use of the services despite this restriction is undertaken at their own risk and waives, to the extent permitted by applicable law, any claim against oneSubnet arising from such use.
Acceptable Use
You must use our services in accordance with applicable laws and our Prohibited Activities. Any abuse will result in suspension or termination without refund.
Payment
Services are billed according to current rates. Payment is due in advance for each billing period. In case of non-payment, the service will be suspended after a grace period.
Termination
You may terminate your service at any time from your client area. No partial refund will be issued for unused periods.
Warranty
oneSubnet guarantees 99.9% availability for all services. Planned downtime will be announced in advance.
Backups
oneSubnet provides an automatic backup system on most of its services. Backups are only performed if the customer has configured them themselves in their service settings via the client area. oneSubnet cannot be held responsible for data loss resulting from the customer's failure to configure backups, or from customer storage failure. The customer is solely responsible for regularly verifying that their backups are functioning properly.
Liability
oneSubnet's liability is strictly limited to direct material and immaterial damages, to the exclusion of any loss of opportunity, profit, revenue or indirect data loss suffered by the customer. oneSubnet is not responsible for data loss or interruptions due to external causes. The customer is responsible for backing up their own data. oneSubnet recommends maintaining independent backup copies outside of the oneSubnet infrastructure.
Changes
oneSubnet reserves the right to modify these terms at any time. Changes take effect upon publication on the website.
Applicable Law
These terms are subject to French law. Any dispute will be submitted to the competent courts of Paris.
